Terms of Service

These Terms of Service (“Terms”) govern your use of the hosting and related services provided by [Company Legal Name] (“Company”, “we”, “us”, or “our”). By creating an account, purchasing a plan, or using any part of our Services, you agree to these Terms.

1) Definitions

  • Services: Web hosting, VPS/dedicated servers, domain registration, SSL, email, migrations, and related add-ons.
  • Customer / you: The individual or entity that orders or uses the Services.
  • Order: A purchase via our site, billing portal, or signed quote/SOW.
  • AUP: Acceptable Use Policy (Section 5).
  • Personal Data: As defined by GDPR and applicable law.

2) Acceptance & Eligibility

By using the Services, you confirm that you have the legal capacity to enter into these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.

Tip: Keep your account email and billing info accurate to avoid service interruptions.

3) Scope of Services

  • Hosting (shared/WordPress, reseller), VPS (KVM), dedicated servers, email, DNS, SSL, and migrations.
  • We may update features, data center locations, network routing, or hardware without notice to improve reliability and performance.
  • Beta features are provided “as is” and may be modified or discontinued.

4) Accounts, Security & Migrations

  • You are responsible for all activity under your account and for keeping credentials secure.
  • We may require multi-factor authentication, strong passwords, and abuse checks.
  • Free migrations: one per site within 30 days of first purchase (like-for-like stack; complex custom stacks may be scoped/quoted).
  • We may decline migrations that pose security, licensing, or policy risks.

5) Acceptable Use Policy (AUP)

You agree not to use the Services for any unlawful, harmful, or abusive purpose. Prohibited activities include (non-exhaustive):

  • Malware, botnets, DDoS, port-scanning, brute-force, or interference with networks.
  • Spam, unsolicited bulk email, or contact list purchases/scraping.
  • Phishing, fraud, deceptive practices, or identity theft.
  • Infringing, counterfeit, or illegal content; CSAM; hate or terror content; instructions to commit violence or crime.
  • Crypto mining on shared/reseller plans; on VPS/dedicated only with prior written approval and compliance.
  • High-risk services (e.g., stressers/booters, open proxies/relays, public VPN exit nodes) without explicit approval.
  • Resource abuse (excessive CPU/RAM/IO, file count explosions, runaway cron jobs) impacting platform stability.

We may remove content, rate-limit, suspend, or terminate Services to protect the platform.

6) Email & Anti-Spam

  • Bulk or marketing email requires verified opt-in lists and compliance with CAN-SPAM/GDPR/ePrivacy.
  • Sending reputation is shared; we may set rate limits, require dedicated IPs, or request list proof.
  • Prohibited: third-party lists, purchased leads, snowshoeing, misleading headers, URL shortener abuse.

7) Billing, Renewals & Refunds

8) Domains, WHOIS & DNS

  • Domain registrations, transfers, and renewals are non-refundable once submitted to the registry.
  • You are responsible for accurate WHOIS data and timely renewals. We are not liable for expiration or loss of registration.
  • Some TLDs require additional docs; registrations may be delayed or rejected by registries.
  • DNS changes can take time to propagate; availability is not guaranteed during propagation windows.

9) Backups & Data Retention

  • We provide periodic backups for shared/reseller plans on a best-effort basis; retention and frequency may vary.
  • Backups are not guaranteed; you are responsible for your own backups, especially for VPS/dedicated servers.
  • Deleted accounts may be purged after [e.g., 7–30 days]. Retrieval after purge is not possible.

10) Support Scope

  • We support platform availability, control panel access, network connectivity, and base server stack.
  • Best-effort help with CMS installs, plugins, themes, and caching; custom code issues may require a paid engagement.
  • Emergency abuse/security cases may be prioritized; response times are not guaranteed.

11) Privacy, GDPR & Data Processing

  • We are a data controller for account/billing data and a processor for content you host.
  • GDPR applies to EU data subjects. A Data Processing Addendum (DPA) is available on request.
  • You must obtain valid consent for personal data you collect and configure your properties to meet cookie/ePrivacy rules.
  • We may process data with sub-processors (e.g., datacenters, DDoS/anti-abuse tools) disclosed in our Privacy Policy.

12) IP Addresses, Fair Use & Resource Limits

  • IP addresses are leased, not owned; they may change for operational reasons with notice when feasible.
  • Fair-use limits (inode counts, CPU minutes, I/O) may apply on shared/reseller tiers; persistent overages may require plan upgrades.
  • Open proxies, Tor exits, or public VPN exits require prior written approval.

13) Third-Party Software & Licenses

  • Some features depend on third-party licenses (e.g., control panel, web server, malware scanner). If a vendor changes terms, features may be altered.
  • You are responsible for licensing of any proprietary apps you install on VPS/dedicated servers.

14) Content, DMCA & Copyright

  • You are solely responsible for content you host. We do not pre-screen content.

  • We follow a notice-and-takedown process and may suspend repeat infringers.

15) Security, Abuse & Suspension

  • You must keep software up to date and use strong credentials.
  • We may suspend/limit Services for security threats, AUP violations, non-payment, or legal requests.
  • Security features reduce risk but do not guarantee prevention of incidents.

16) Disclaimers & Limitation of Liability

Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or business interruption. Our aggregate liability for any claim is limited to the fees paid by you for the affected Service in the three (3) months preceding the event.

17) Termination

  • You may cancel at any time via the billing portal or by ticket. Refund eligibility follows Section 7.
  • We may terminate for cause (abuse/non-payment/legal risk) with or without notice depending on severity.
  • Upon termination, your right to use the Services stops immediately; data may be deleted per Section 9.

18) Changes to Terms

We may update these Terms from time to time. The “Effective date” above shows the latest version. Material changes will be notified via email or portal notice. Continued use after changes constitutes acceptance.

Do you offer a money-back guarantee?

Yes—7 days on Shared Hosting and VPS. If the plan includes third-party licenses billed monthly (e.g., cPanel), refunds are not possible. Domains, SSL, dedicated IPs, add-on licenses, and completed migration/setup work are non-refundable.

Can I send newsletters or campaigns?

Yes, with opt-in lists and compliance. We may require dedicated IPs and rate limits. Purchased lists are prohibited.

What if my site is compromised?

We may isolate/suspend to protect the platform and assist with remediation steps. Keeping software updated is your responsibility.
